General Terms and Conditions

PREAMBLE

These General Terms and Conditions of Sale (GTC) define the rights and obligations of the parties in connection with the sale of Ora Swimwear brand products, marketed via the website www.oraswimwear.com. By confirming their order, the customer unreservedly accepts these GTC.

 

COMPANY INFORMATION

Ora Swimwear is a brand operated by B&G INC., a limited liability company with a capital of 1,000 euros, registered with the Pointe-à-Pitre Trade and Companies Register under number 938 792 066 RCS, whose registered office is located at 8 rue de la Chapelle, ZI de Jarry, 97122, Baie-mahault, Guadeloupe. Its intra-community VAT number is FR28938792066.

 

PRODUCTS

Ora Swimwear offers swimwear and accessories for sale. Each product is accompanied by a description and photographs. Colors may vary slightly depending on your monitor settings. Inventory is updated regularly, but if the item is unavailable after ordering, the customer will be notified and given the option to receive a refund or exchange.

 

ORDERING PROCESS

Orders are placed online via the website. The customer selects the products of their choice, adds them to their shopping cart, and confirms their order after accepting these Terms and Conditions. Once the order is validated and payment accepted, a confirmation is sent by email.

Ora Swimwear reserves the right to cancel an order in the event of suspected fraud or a previous dispute with the customer.

 

PRICE AND PAYMENT

Prices are listed in euros, inclusive of all taxes (TTC), excluding delivery charges. Ora Swimwear reserves the right to change its prices at any time, but products will be invoiced based on the rates in effect at the time of the order.
The accepted payment methods are:

- Bank card (Visa, Mastercard, American Express)

- PayPal

- Any other means indicated on the site

Payment is secure and is made via an encrypted payment platform.

 

DELIVERY

Products are delivered to the address indicated by the customer when ordering. Several delivery methods are available:

- Standard delivery

- Express delivery

Once the order has been shipped, an email containing a tracking number will be sent to the customer. Ora Swimwear cannot be held responsible for delays caused by carriers. In the event of a delivery problem, the customer must contact the carrier and report the incident to Ora Swimwear.

For deliveries to the French overseas territories and outside the European Union, customs fees and other taxes may be applied by local authorities. These fees are the sole responsibility of the customer. Ora Swimwear cannot be held responsible for their payment or any delays related to customs clearance.

 

RIGHT OF WITHDRAWAL AND RETURNS

In accordance with current legislation, the customer has 14 days from receipt of the products to exercise their right of withdrawal. To return an item, the following conditions must be met: 

- The product must not have been worn (except for fitting), washed or damaged

- Labels and hygienic protections must be intact

- The return must be made in the original packaging

- When trying on, the customer must keep their underwear on to preserve the hygiene of the product.

Return shipping costs are the customer's responsibility. After receiving and inspecting the returned product, Ora Swimwear will refund the returned product to the original payment method within 30 days. However, if the returned product presents any anomalies (missing labels, stains, odors, deterioration, or any other signs of use), Ora Swimwear reserves the right to refuse the refund or deduct an amount from the refund corresponding to the loss in value of the product.

 

WARRANTIES AND LIABILITY

The products benefit from legal guarantees of conformity and hidden defects (articles L.217-4 et seq. of the Consumer Code). In the event of a defective product, the customer can contact customer service for an exchange or a credit note equivalent to the value of the product.

Ora Swimwear declines all responsibility for misuse of products or normal wear and tear.

 

CUSTOMER SERVICE AND ORDER TRACKING

Customer service can be reached by email at support@oraswimwear.com or via the website's contact form. Customers can also track their order by logging into their customer account on the website.

 

INTELLECTUAL PROPERTY

All elements of the Ora Swimwear website and products are protected by intellectual property rights. Any reproduction, in whole or in part, is prohibited without prior authorization.

 

PERSONAL DATA

Ora Swimwear is committed to protecting customer personal data. The information collected is used solely for order processing and customer relationship management. It is never shared with third parties.
In accordance with the General Data Protection Regulation (GDPR), the customer has the right to access, rectify and delete their personal data, which they can exercise by contacting: support@oraswimwear.com .

 

DISPUTES AND APPLICABLE LAW

These General Terms and Conditions are subject to French law. In the event of a dispute, an amicable solution will be sought as a priority. Failing agreement, the French courts will have sole jurisdiction.

 

MODIFICATION OF THE GTC

Ora Swimwear reserves the right to modify these Terms and Conditions at any time. The applicable Terms and Conditions are those in effect on the date of the order.
